Defining Personal Information

The Chief Privacy Officer (CPO) for RCG is Thomas M. Laudise, Corporate Counsel. This is communicated both internally and externally for public knowledge. The CPO is responsible for understanding the broad impact of privacy, for the implementation of policies and procedures, and handling any complaints.
RCG is responsible for personal information in its possession or custody, including information that has been received by a third party and requiring their adherence to privacy legislation.
(2) IDENTIFYING PURPOSES
RCG will identify the purposes for which personal information is collected; at or before the time the information is collected.
The primary purposes for the collection of personal information is to deliver services and to keep individuals informed and up-to-date on the activities of RCG, including programs, services, special events, projects, employment opportunities, solicitations and more through periodic contacts.
When personal information that has been collected is to be used for a purpose not initially identified, the new purpose shall be identified prior to use.
Personal information may be supplied in connection with a job application or inquiry, whether advertised on this website or otherwise, you may provide us with information about yourself, such as a resume or curriculum vitae. It may also include sharing certain information with other Business Partners (subject to any confidentiality obligations that may exist), or RCG connection with a particular transaction or program, we may also contact you as part of customer satisfaction surveys or for market research purposes.
If you represent a RCG supplier, vendor or consultant, you may visit a RCG website intended specifically for use by you. We may use the information provided on that site in connection with entering into or performing a transaction with you. For example, this may include sharing information with other parts of RCG, RCG’s Business and Alliance Partners, customers, shipping companies, financial institutions, postal or government authorities involved in fulfillment. Personal information shall be sufficiently accurate, complete and up-to-date to minimize the possibility that inappropriate information be used to make a decision about the individual.
RCG will update an individual’s personal information only when necessary to fulfill the specific purposes for which it was collected.
RCG will take steps to protect personal information from theft and loss, as well as unauthorized access, disclosure, copying, use or modification. The methods of protection include:
Organizational measures; and
RCG will make readily available to individuals specific information about RCG’s policies and practices relating to the management of personal information. RCG will make these policies and practices understandable and easily available through a variety of forms, including this very positing. Information about these policies and practices may be made available in person, in writing, by telephone, in publications and, as you can see, on the RCG website. The information made available will include:
the name or title and business address of the person who is accountable for RCG’s privacy policies and practices and to whom complaints or inquiries can be forwarded;

(8) INDIVIDUAL ACCESS
Upon request by an individual, RCG shall inform the individual of the existence, use and/or disclosure of his or her personal information and be given access to that information. An individual shall be able to challenge the accuracy and completeness of the information and have it amended as appropriate.
Individuals have the right to be given access to their personal information (except where it contains references to other individuals or if it cannot be disclosed for legal, security or commercial proprietary reasons). RCG will advise the individual of the reason for denying the access request.
RCG will respond to an individual’s request within a reasonable time – no more than 30 days – and at minimal or no cost to the individual related to retrieval, photocopying and delivery.
In providing an account of third parties to which it has disclosed personal information about an individual, RCG will attempt to be as specific as possible. When it is not possible to provide a list of the organizations to which it has actually disclosed information about an individual, RCG will provide a list of organizations to which it may have disclosed information about the individual.
(9) CHALLENGING COMPLIANCE
An individual can challenge RCG’s compliance with the above principles through the Chief Privacy Officer.
RCG has to put these procedures in place to receive and respond to complaints or inquiries about its policies and practices relating to the handling of personal information. The complaint procedure is accessible and simple to use. To initiate a complaint all an individual must do is notify Chief Privacy Officer and provide information and assistance to allow RCG to properly investigate the claim.
RCG shall investigate all complaints. If a complaint is found to be justified, RCG will take appropriate measure, including, if necessary, amending its policies and procedures.

Any party may request arbitration. Requests to arbitrate must be filed with the other party and with JAMS within ninety (90) calendar days after the claim or dispute arises or the act or acts as to which arbitration is brought occur. If an individual fails to file a request for arbitration with RCG and JAMS within ninety (90) calendar days after the claim or dispute arises, that claim or dispute it will be conclusively resolved against the individual even if there is an applicable statute of limitations that may have given the individual more time. Any judgment upon the award rendered by the arbitrator may be entered in any court of competent jurisdiction. The costs of such arbitration shall be borne equally by the parties with each party also bearing its own attorneys’ fees and any costs associated with presenting its proof.
